What a SAAQ lawyer in Trois-Rivières does
We take over your file wherever it stands, including when the denial is already in writing. If the accident happened on the job or on the road between two work sites, our CNESST lawyer page covers the other side of the same event.
Initial claim built on the medical file
We gather the accident report, the imaging, the emergency room notes and your proof of income, then file a claim that describes the mechanism of the impact as much as the injury. The way the injury is described at the start follows the file for years.
Administrative review of a SAAQ decision
A denial, a premature consolidation date or a wrong salary base can be contested in writing with the SAAQ. We draft the request for review and back it with a counter-expertise when the disagreement is about the medical assessment.
Hearing at the Administrative Tribunal of Québec
When the review upholds the decision, the next step is an appeal before the TAQ (Tribunal administratif du Québec). We prepare the evidence, examine the experts and negotiate in conciliation when conciliation serves your interests.
SAAQ claims on Highways 40 and 55
Here, the layout of the road network produces a specific type of injury. Highway 40 crosses the city from east to west, Highway 55 runs north from the south shore to the 40-55 interchange and the Laviolette Bridge takes the full force of the winds off the St. Lawrence. Speeds are high and there are few merge points, so collisions are deceleration impacts.

Neck and spinal injuries at highway speed
A rear-end collision at 100 km/h in slowing traffic or a skid on the 55 in blowing snow sends the energy through the spine. Whiplash, a herniated disc, facet joint syndrome and mild traumatic brain injury share one weakness before the SAAQ: they barely show on initial imaging. This is exactly where compensation gets lost.
Mauricie regional roads and transport times
On Route 138, 153 or 351, ambulances take longer to arrive and the trip to the trauma centre is longer. The first clinical notes are then written several hours after the impact, often about a patient who reports only the worst pain. We document that gap, because the SAAQ otherwise uses it to break the causal link.
Winter run-offs and road conditions
Black ice on the bridge deck, blowing snow in open country, a frozen road surface at a highway exit: Quebec’s no-fault system pays benefits without asking who lost control. Road conditions cannot be used to deny your claim. What they can do is explain how violent the impact was, and that helps.
Two 60-day SAAQ appeal deadlines
Contesting a decision involves two consecutive 60-day deadlines: the first to request an administrative review of a decision from the date you are notified, the second to take the review decision to the Administrative Tribunal of Québec.
The full process, the no-fault system and every available recourse are explained on our SAAQ lawyer page. The key point here is that these deadlines extinguish rights. A late appeal requires a serious reason that you will have to prove.
SAAQ benefits after a road accident
The income replacement indemnity (IRI) is worth 90% of your net annual income, calculated on a gross annual income that the SAAQ caps and indexes every year. It is not payable before the seventh day following the day of the accident, and it is then paid every 14 days.
Next come the lump-sum indemnity for non-pecuniary loss when there is permanent impairment, personal home assistance, reimbursement of expenses and rehabilitation measures. Personal home assistance is the benefit most often overlooked in the files we take over.

A SAAQ denial to overturn?
Send us the decision and your medical reports: within 24 hours, we will tell you whether an appeal holds up and on what grounds.
How we handle SAAQ claims in Mauricie
The initial consultation takes place by phone, at your home or at our offices, whichever suits you best. Home visits are available for clients whose recovery or mobility makes the trip unreasonable. This first conversation is free and commits you to nothing.
You also choose who represents you: a lawyer who is a member of the Barreau du Québec, or an administrative recourse expert at a lower cost when the file does not require pleading in court. Few firms offer both, and that choice is often what makes an appeal possible in practice.
Province-wide coverage
SAAQ lawyer in other cities
We appear before the TAQ throughout the province from our Montreal and Québec City offices, and we travel when a file requires it.
See also our pages for Montreal, Québec City and Laval. A file that involves the road, the workplace and a criminal act all at once is handled by our team that covers all three systems.
Frequently asked questions
FAQ: SAAQ lawyer in Trois-Rivières
Do I have to travel to start an appeal?
No. A Trois-Rivières file is handled by phone, by email and by exchanging documents, and we come to your home when your recovery or mobility makes the trip unreasonable. The first consultation is free and without obligation, whichever option you choose.
When does the SAAQ start paying the IRI?
The income replacement indemnity is not payable before the seventh day following the day of the accident. It is then paid every 14 days for as long as your disability is recognized. If the first payment is delayed well beyond that, a document is usually missing from the file or your salary base is being disputed.
Does whiplash qualify for SAAQ compensation?
Yes, as soon as it results from the accident and causes a disability. The real difficulty is that these injuries are hard to see on imaging, which leaves room for interpretation. Consistent clinical follow-up, with notes that describe your functional limitations as well as your pain, carries more weight than a single detailed report written late.
Does the TAQ or the TAT hear my appeal?
The Administrative Tribunal of Québec (TAQ). The Administrative Labour Tribunal (TAT) hears CNESST cases, not road accident cases. The confusion is common and costly, because the two tribunals apply different laws and follow different procedures. If your accident happened at work, both systems may apply, and how they fit together should be planned from the start.
Is a winter run-off-the-road crash covered?
Yes. Quebec’s system pays benefits regardless of anyone’s fault, so losing control on an icy road leaves you fully eligible for compensation. Road and weather conditions still matter to your file because they help explain how violent the impact was. They are never grounds for excluding you from benefits.
What if the SAAQ says I can work?
This is the most common reason for an appeal. An assessment ordered by the SAAQ concludes that you can return to work, and the payments stop. The answer is an independent counter-expertise, filed within the 60-day review period. Gather the decision, the assessment report and your follow-up notes before you call us: those three documents decide the case.
How do your fees work?
The first consultation costs nothing and commits you to nothing. After that, the fee structure depends on the file and the type of representation you choose: a flat fee, a percentage of the compensation obtained or instalment payments. You know the arrangement and its cost before you authorize anything.
