Our SAAQ lawyer services in Montreal

We step in at any stage of your file, including after the decision has already come down. If your file also involves a CNESST work accident claim or IVAC compensation for victims of crime, our Montreal team handles all three regimes.

    Building your SAAQ claim

We gather the police report, medical reports and proof of income, then file a claim backed by your medical record. A file that is well built from day one prevents half of all disputes.

Application for review within 60 days

An unfavourable decision is contested in writing with the SAAQ. We draft the application for review, support it with an independent counter-assessment when the disagreement is medical and follow the review through to the decision.

    Representation before the TAQ

If the review upholds the decision, the next recourse is the Administrative Tribunal of Québec (TAQ). We prepare the evidence, examine the experts and argue your case. This is the tribunal with jurisdiction over road accidents, never the Administrative Labour Tribunal (TAT).

SAAQ claims from Montreal road accidents

Density changes the nature of the files. In Montreal, a large share of claims comes from vulnerable road users rather than high-speed collisions between vehicles.

Injured pedestrians and cyclists in the city

A pedestrian struck in a crosswalk and a cyclist hit by an opening car door are covered by the public plan in the same way as a driver. These files often turn on how the injury mechanism is described, not on who was at fault.

    Collisions on major arteries

The Décarie Expressway, the Metropolitan Expressway, bridges and tunnels produce pileups where several versions of events clash. When the police report is ambiguous, medical evidence becomes the pivot of the file.

Your SAAQ deadlines and what they trigger

Two deadlines govern the whole process, each lasting 60 days: sixty days to apply for review of a decision, then sixty days to contest the review decision before the TAQ.

The full process, the no-fault regime and every recourse are explained on our SAAQ lawyer and road accident page. Above all, remember that these deadlines extinguish rights: once a deadline passes, the decision becomes hard to reopen.

    The benefits the SAAQ pays

The income replacement indemnity (IRI) equals 90% of your net annual income, calculated on a gross income capped by the SAAQ and indexed every year. It is not payable before the seventh day after the accident, and it is then paid every 14 days.

On top of that come compensation for non-pecuniary loss when there are permanent after-effects, personal home assistance, reimbursement of expenses and rehabilitation measures. These secondary items, more than the IRI, are often where money gets lost.

Why trust us with your SAAQ file

Our Montreal office is at 408 McGill Street. We come to your home when convalescence or reduced mobility requires it. The initial consultation is free and without obligation.

You also choose your representation: a lawyer who is a member of the Quebec Bar or a lower-cost administrative recourse expert, depending on how complex your file is. This flexibility is rare in Quebec, and it is often what makes a recourse viable.

    Province-wide coverage

Our SAAQ lawyers elsewhere in Quebec

We plead before the TAQ throughout the province. Files from the greater Montreal area and the regions are handled from our Montreal and Québec City offices, with travel when needed.

We also take on road accident files in Laval, Longueuil, Trois-Rivières and Québec City.

    Frequently asked questions

    FAQ: SAAQ lawyer in Montreal

Am I compensated if the accident was my fault?

Yes. Quebec’s plan is no-fault: the law provides that compensation is granted “regardless of who is at fault.” You are therefore compensated even if you caused the collision. This does not protect you from the penal consequences of an offence, which fall under an entirely separate regime.

How long do I have to contest a decision?

Sixty days from notification to apply for review with the SAAQ, then another sixty days to bring the review decision before the Administrative Tribunal of Québec. These deadlines are strict. If yours is approaching or has just passed, call us before you do anything else.

    Are pedestrians and cyclists covered?

Yes, as soon as an automobile is involved in the accident. In Montreal, a significant share of files comes from pedestrians struck at an intersection and cyclists knocked down by a car door or a right-turning vehicle. Not being behind the wheel changes nothing about your right to compensation.

The SAAQ reduced my indemnity, what should I do?

This is the most common situation. A medical assessment ordered by the SAAQ concludes that you can return to work, then the indemnity drops. The answer is an independent counter-assessment, filed within the review deadline. Gather the decision and the assessment report before you call us, since those are the two documents that decide the outcome.

Can I reopen a closed file if my condition worsens?

Yes, through a claim for a relapse, recurrence or aggravation. You must show a link between the deterioration and the original accident, which rests entirely on medical evidence. The more continuous your medical follow-up has been, the stronger the claim will be.

Do I have to meet you at your office?

No. We receive clients at 408 McGill Street, but we also travel to your home and handle files by phone across Quebec. Many of our clients are just out of hospital or have reduced mobility: the logistics of a meeting should never be what stops a recourse.

How much does your representation cost?

The initial consultation is free and without obligation. After that, fees depend on the type of file and the representation you choose, with flat-fee, percentage or instalment payment options. We give you the plan and its cost before you commit to anything.
